Your privacy is important to us, and we are fully committed to upholding the principles and obligations under Republic Act No. 10173, also known as the Data Privacy Act of 2012 (DPA).

This Privacy Policy explains how we collect, use, protect, and manage your personal data in accordance with Philippine law.


1. Commitment to Philippine Data Privacy Law

ScamGuard.ph operates in strict compliance with the Data Privacy Act of 2012, which mandates the protection of personal information collected by any entity engaged in processing data in the Philippines.

We recognize your rights as a Data Subject, and we undertake all necessary organizational, physical, and technical measures to ensure the confidentiality, integrity, and availability of your personal data.


2. What We Collect

In accordance with Section 16 of RA 10173, we collect only the personal data that is necessary,

We do not collect sensitive personal information unless explicitly required and with your consent.

What Information We Collect

  • We may collect and process two types of personal data:
  • A. Information About the Reporter:
    • Full name
    • Email address
    • Phone number
    • IP address and browser/device information
    • Any additional evidence or information voluntarily submitted
  • B. Information About the Reported Subject:
    • Depending on what the user includes in the report, this may include:
    • Full name or alias of the alleged scammer
    • Contact information (e.g., phone number, email, social media handles)
    • Transaction details (e.g., dates, amounts, payment methods)
    • Screenshots or messages (with identifying info)
    • Any relevant public business details (e.g., online store, marketplace profile)
  •  How We Use This Information
    • The information collected about subjects is used only for the following lawful and legitimate purposes:
    • To evaluate and internally verify the report
    • To flag patterns of fraud or repeated offenses
    • To provide information to relevant government authorities or enforcement agencies when legally required, and only when demanded by law enforcement.
    • We are committed to processing all personal data in a fair, transparent, and non-prejudicial manner as outlined under Section 11 of RA 10173.
  • Data We Do Not Publicly Share
    • ScamGuard.ph does not publish personally identifiable information (PII) of reported subjects unless:
    • It is already publicly available, or
    • The user has received explicit consent to disclose such information, or
    • A competent authority has requested or authorized such disclosure
    • This means we do not publicly display:
    • Government-issued ID numbers
    • Private residential addresses
    • Phone numbers
    • Banking or financial information
    • Conversations that contain personal information unless redacted
    • All sensitive personal information, as defined in Section 3(l) of RA 10173, is strictly protected.
  • Who Has Access
    • Only authorized administrators of ScamGuard.ph, who are trained in data privacy compliance, have access to subject data for internal investigation purposes.
    • We do not sell, trade, rent, or disclose this data to third parties or the public unless:
    • Required by law (e.g., subpoena, court order)
    • Requested by a government enforcement agency such as the NBI Cybercrime Division
    • The data subject has provided explicit written consent
  • Retention and Disposal
    • We retain subject data only as long as necessary to:
    • Complete internal reviews or audits
    • Comply with legal obligations
    • Support an ongoing investigation or cooperation with authorities
    • All personal data is securely deleted or anonymized when no longer required, per Section 19 and 20 of RA 10173.

3. Purpose of Collection

We collect your information only for legitimate purposes, including but not limited to:

  • Investigating and tracking scams
  • Responding to inquiries and reports
  • Providing updates about the platform and services
  • Protecting the financial interests of the client.

All data collection adheres to the principle of proportionality, as outlined in Section 11 of the DPA.


4. Security Measures

As required by Section 20 of the Data Privacy Act, we implement industry-standard organizational, physical, and technical security measures including:

  • SSL encryption
  • Secure storage of user data
  • Role-based access controls
  • Regular audits and assessments
  • Incident response protocols

We also ensure our partners and service providers comply with similar data protection standards.


5. Retention and Disposal

In compliance with Section 11(f) of RA 10173, we retain your personal data only as long as necessary for the purposes outlined or as required by law. Once no longer needed, data will be safely and securely destroyed in accordance with NPC guidelines.


6. Data Sharing and Disclosure

ScamGuard.ph does not sell or trade your personal information. We may only share your data:

  • When required by law
  • With your explicit consent
  • With regulatory agencies (e.g. NPC, NBI) if a formal investigation is initiated

7. Cookies and Analytics

We may use cookies and third-party analytics tools to improve performance and user experience. These do not collect personal data unless explicitly stated.

This Privacy Policy may be updated to remain compliant with changes to the law or improvements to our services. All changes will be posted on this page and, where appropriate, notified to you.
